1. Scope of application
The online shop of the ARTIG METALL brand is operated by LASER & more Edelstahl Komponentenfertigungsges.m.b.H. These terms and conditions govern the terms of use of the online shop, the ordering process, as well as the terms of delivery, payment and the right of withdrawal. Our offers, services and deliveries are provided exclusively on the basis of these terms and conditions. These shall also apply to all future business relations, even if they are not expressly agreed again. By using the online shop and placing an order, you agree to these terms.
2. Contractual partner, conclusion of contract
The purchase contract is concluded with LASER & more Edelstahl Komponentenfertigungsges.m.b.H. hereinafter referred to as the contractor.
Our online shop is aimed exclusively at consumers, hereinafter referred to as clients. The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction tools provided and explained in the order process. By clicking the order button, you are placing a binding order for the goods in your shopping basket. Confirmation of receipt of your order will be sent by email immediately after you send your order.

The language(s) available for concluding the contract: German, English, Italian, French.
We save the text of the contract and send you the order data by e-mail. You can also view the terms and conditions here on this page at any time.
4. Payment terms
In our shop, the following payment methods are available to you:
Prepayment
If you choose the prepayment method, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.
Credit card
When you place an order, you provide your credit card details. Your card will be charged immediately after you place the order.
PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal, you must be registered with PayPal, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions during the ordering process.
Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, you must have a bank account that is activated for online banking, you must identify yourself accordingly and confirm the payment instruction. Your account will be debited immediately after the order has been placed. You will receive further information during the ordering process.
Google Pay
To pay the invoice amount via the payment service provider Google Pay, you must be registered with Google, have activated the Google Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further instructions during the ordering process.
Apple Pay
To pay the invoice amount via Apple Pay, you must be registered with the service provider Apple, have activated the Apple Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further instructions during the ordering process.
5. Retention of title
The goods remain our property until full payment has been received.
6. Delivery terms
Shipping costs are added to the stated product prices. These are calculated and displayed during the checkout process. Detailed information can be found on the ‘Shipping’ page.
We deliver via the dispatch route. For delivery via the dispatch route, we commission a transport company. Delivery is made to the delivery address you provided when you placed your order. The delivery is made to the kerbside.
Delivery takes place as follows:
You will receive an order confirmation with the expected delivery week. This date is non-binding and may vary under certain circumstances.
Once the order has been accepted by the carrier, you will be contacted by telephone or email within one week by the transport company to arrange a delivery date with you. The telephone number you entered or the telephone number contained in your email signature will be used for this.
If you provide an incorrect delivery address, we will charge you for the costs incurred.
The delivery of the goods is carried out via our premises in 4600 Wels (Austria), which is also the place of performance.
The delivery area is the EU member states and Switzerland, unless another delivery country has been agreed.
Unforeseen circumstances may delay delivery. Consequential costs cannot be claimed.
Unpack your goods immediately after delivery to prevent condensation. Check each order carefully for possible defects. If there is visible damage, this should be reported immediately to the carrier on the delivery note. Complaints must be reported to the contractor by email within two working days.
7. Claims
The goods must be checked upon delivery. Visible defects, transport damage, quantity errors or wrong deliveries must be noted on the delivery note/consignment note (ideally also documented with a photo) and reported to the contractor in writing without delay. Defects that are not immediately apparent must be reported to the contractor as soon as they are detected, within the statutory period and within two working days at the latest.
8. Warranty and liability
8.1 Unless otherwise expressly agreed below, the statutory warranty rights shall apply.
8.2 Minor deviations in colour and design, in particular in the course of technical development, do not entitle the client to make a complaint.
8.3 The client shall only be entitled to warranty claims if the delivered goods have been used properly and as intended. Any preparatory work not carried out properly by external companies or any further work shall exclude any warranty claim against the contractor.
8.4 The contractor does not guarantee that the photos published in the web shop are identical to the goods actually delivered.
8.5 The contractor is only liable for damages that are based on intentional or grossly negligent breach of contract. This does not apply to liability for personal injury and claims under the Product Liability Act. The statutory provisions apply here.
9. Cancellation policy and returns
Cancellations will not be accepted.
The customer bears the shipping costs for returns. If the item is not returned in its original condition, the customer is responsible for any loss of value.
10. Cancellation policy
10.1 Consumers have the statutory right of cancellation, as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of cancellation.
10.2 Consumers have a statutory right of cancellation when concluding a distance selling transaction, about which we will instruct you as follows: You have the right to cancel this contract within 14 days without stating any reasons. The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
10.3. There is no right of cancellation for sales contracts for the delivery of goods that are not prefabricated, are made to customer specifications or are clearly tailored to the personal needs of the buyer (e.g. dimensions, shapes, colours, or changes made at your request).

to inform you of your decision to withdraw from this contract by means of a clear written declaration (e.g. a letter, fax or email). You may use the attached withdrawal form template for this purpose.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
11. Consequences of cancellation
11.1 If you revoke this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to revoke this contract. If you only wish to exercise your right of cancellation for some of the goods you have ordered, you must bear the delivery costs for the delivery in the amount that would have been incurred if you had only ordered the goods remaining with you. We will use the same means of payment for this repayment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged for this repayment. We may withhold the reimbursement until we have received the goods back. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
11.2 In the event of cancellation, you will bear the direct costs of the return.
11.3 You must pay for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods (especially improper packaging when returning).

12. Data protection
12.1 The contractual partner agrees that his personal and voluntarily provided data, namely first name, surname, address, email address and telephone number, may be processed and stored by LASER & more Edelstahl Komponentenfertigungsges.m.b. H. are processed and stored by LASER & more Edelstahl Komponentenfertigungsges.m.b.H. in accordance with legal requirements.
12.2 The contractual partner also agrees that the company name or the project name of the construction project supplied, as well as photos taken by LASER & more Edelstahl Komponentenfertigungsges.m.b.H. and photos provided by the customer, may be displayed as a reference on the homepage and online shop of LASER & more Edelstahl Komponentenfertigungsges.m.b.H. (www.artigmetall.com, www.shop-artigmetall.com and www.laser-more.com) and on ARTIG METALL printed material.

13. Place of performance, place of jurisdiction and applicable law
The place of performance for delivery, payment and other services is 4600 Wels. Depending on the subject matter, the district court of Wels or the regional court of Wels is agreed as the place of jurisdiction for any disputes. Austrian law applies, excluding the referral norms of Austrian international private law and the provisions of the UN Sales Convention.
14. Errors, inaccuracies and omissions
Occasionally there may be information on our site or in the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right, in our sole discretion, to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We assume no obligation to update, modify or clarify information in the service or on associated websites, including but not limited to price information, unless required by law. An update or refresh date specified in the service or on an associated website should not be understood as an indication that all information in the service or on an associated website has been changed or updated.
15. Final provision
Should any provision of these terms and conditions or any provision under any other agreement be invalid, the validity of all other provisions or agreements shall not be affected. In this case, the parties agree to make a legally effective agreement today that comes as close as possible to the economic purpose of the invalid provision, whereby Austrian law shall apply exclusively.
